Terms of Use
These Terms of Use govern access to the IoThinkTank website, award submissions, program materials, payments, recognition assets, and related services.
Last Updated: July 21, 2026
These Terms of Use (“Terms”) govern your access to and use of the IoThinkTank website, iothinktank.com, and related award submission, communication, payment, judging, recognition, and program activities operated by IoThinkTank (“IoThinkTank,” “we,” “our,” or “us”).
By accessing the website, submitting an award entry, making a payment, signing up for communications, or otherwise using IoThinkTank services, you agree to these Terms. If you do not agree to these Terms, do not use the website or submit an award entry.
1. The IoThinkTank Awards
IoThinkTank operates awards programs recognizing outstanding Internet of Things technologies, companies, products, platforms, deployments, leaders, and related achievements. Award categories, eligibility requirements, judging criteria, deadlines, fees, recognition details, and program structures may vary by category or award cycle.
IoThinkTank may modify, extend, close, suspend, merge, rename, postpone, or discontinue an award category, deadline, judging process, recognition asset, or program feature at its discretion.
IoThinkTank may also determine that no award will be presented in a category or award cycle.
2. Award Submissions
When submitting an award entry, you agree to provide accurate, current, and complete information. You represent that you have the authority to submit the entry on behalf of the company, organization, product, platform, deployment, individual, or solution identified in the submission.
You are responsible for ensuring that your submission materials do not violate third-party rights, confidentiality obligations, employment agreements, customer agreements, nondisclosure agreements, intellectual property rights, privacy rights, or applicable laws.
IoThinkTank may reject, remove, disqualify, reassign, or decline to review any submission that is incomplete, inaccurate, misleading, inappropriate, unlawful, submitted in an unsuitable category, received after the applicable deadline, or inconsistent with program rules or category requirements.
If IoThinkTank believes an entry may be a stronger fit for another category, we may contact the entrant to discuss reassignment. Category changes are not guaranteed and remain subject to program availability and approval.
3. Fees, Payments, Invoices, and Refunds
Award submission fees are charged for the review and consideration of an entry. Payment does not guarantee selection as a winner, finalist, runner-up, honorable mention, or other recognized participant.
Unless otherwise stated in writing by IoThinkTank, all award submission payments are non-refundable once submitted. This includes entries that are not selected, entries submitted to an unsuitable category, entries later withdrawn by the entrant, entries that are disqualified, and entries submitted near or after a deadline.
Organizations requesting payment by invoice must contact IoThinkTank before submitting through a standard application form that requires immediate payment. Invoice arrangements, payment terms, application access, and deadline accommodations are subject to approval.
Failure to complete an approved invoice payment may result in the entry being withheld from judging, disqualified, or removed from consideration.
Questions regarding payments, receipts, invoices, or award submissions may be directed to awards@iothinktank.com.
4. Deadlines and Extensions
Entries must generally be received by the deadline published for the applicable award category. IoThinkTank may extend deadlines, offer grace periods, accept late submissions, or close submissions early at its discretion.
An entrant should not assume that a deadline extension has been granted unless confirmation has been provided directly by IoThinkTank.
Reaching out before a published deadline does not automatically reserve an entry or guarantee additional time, although IoThinkTank may choose to provide reasonable accommodations when appropriate.
5. Evaluation and Judging
Award submissions are evaluated according to IoThinkTank’s program standards, category criteria, supporting evidence, measurable results, innovation, execution, adoption, and overall fit for the applicable award.
Judging may involve IoThinkTank team members, editors, reviewers, judges, contractors, consultants, or authorized program partners.
IoThinkTank reserves the right to determine eligibility, category fit, scoring, finalist status, winner status, runner-up status, honorable mention recognition, and whether recognition will be issued in a given category or cycle.
IoThinkTank is not required to provide scoring details, comparative rankings, judge identities, judge comments, individualized feedback, deliberation notes, or explanations regarding final decisions.
Award decisions are final unless IoThinkTank determines that a correction, reassessment, or withdrawal is necessary because of inaccurate information, misconduct, eligibility concerns, or other material circumstances.
6. Publicity and Recognition
IoThinkTank may use entrant names, organization names, product or solution names, logos, website links, submitted descriptions, approved quotes, images, videos, and other permitted materials for award administration, judging, winner announcements, newsroom posts, website listings, social media, email communications, presentations, historical records, and other program-related purposes, subject to the license granted in Section 9.
If a company, organization, product, solution, executive, or individual is selected as a winner, finalist, runner-up, honorable mention, or other recognized participant, IoThinkTank may publicly identify and promote that recognition using the materials and permissions described in these Terms.
If you need to restrict use of a company name, logo, quote, image, customer reference, or other material, you must notify IoThinkTank in writing at the time of submission or as soon as reasonably possible by emailing awards@iothinktank.com.
IoThinkTank may provide drafts of winner pages, announcements, or press materials for factual review. Unless otherwise stated, this review is intended to identify corrections, permissions concerns, or factual inaccuracies. Editorial control over IoThinkTank publications remains with IoThinkTank.
7. Embargoes and Announcement Timing
Entrants and recognized organizations may receive award results before the official public announcement. When an embargo or publication date is provided, recipients agree not to disclose, publish, distribute, promote, or share the result publicly before the designated announcement time.
Internal sharing with employees, executives, legal teams, communications teams, or approved service providers may be permitted, provided those recipients also honor the embargo.
IoThinkTank may change a scheduled announcement date or time when operational, editorial, legal, or program circumstances require it.
8. Confidential Information
You should not submit confidential, proprietary, sensitive, regulated, or non-public information unless you are authorized to do so and are comfortable sharing that information for award review purposes.
Materials clearly identified in writing as confidential will not be intentionally published without permission. However, award submissions may be accessed and reviewed by IoThinkTank team members, judges, reviewers, contractors, consultants, or authorized program partners involved in program administration and evaluation.
Public-facing award descriptions, winner profiles, summaries, newsroom posts, and announcements may be based on information included in the submission, information approved by the entrant, or information otherwise publicly available.
Marking information as confidential does not guarantee that it will be considered during judging if it cannot reasonably be shared with authorized reviewers.
9. Entrant Materials and Intellectual Property
You retain ownership of the materials you submit to IoThinkTank.
By submitting an entry, you grant IoThinkTank a non-exclusive, worldwide, royalty-free license to access, review, reproduce, display, distribute, format, resize, convert, edit, summarize, and publish the entrant’s organization name, product or solution name, trademarks, logos, submitted images, and non-confidential submission materials as reasonably necessary for the administration, judging, announcement, promotion, documentation, and historical archiving of the IoThinkTank Awards.
This license includes use on IoThinkTank websites, winner pages, newsroom content, email communications, social media, award information materials, presentations, promotional assets, and other program-related communications.
IoThinkTank will not materially alter an entrant’s logo except as reasonably necessary for sizing, placement, file conversion, background treatment, or presentation.
You represent that you have all rights, licenses, permissions, and approvals necessary to submit the materials and grant IoThinkTank the rights described in these Terms.
IoThinkTank is not responsible for disputes between entrants and third parties regarding ownership, authorization, confidentiality, attribution, trademark rights, copyright, or the right to submit or use particular materials.
10. IoThinkTank Materials and Website Content
The IoThinkTank website, award names, program descriptions, badges, graphics, logos, designs, written content, page layouts, judging materials, recognition assets, and other program materials are owned by or licensed to IoThinkTank and may be protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, sell, license, or exploit IoThinkTank materials without prior written permission, except for official recognition or promotional assets provided by IoThinkTank for authorized use.
11. Use of Award Badges and Recognition Assets
Winners, finalists, runners-up, honorable mentions, or other recognized participants may receive official IoThinkTank badges, banners, graphics, or related recognition assets.
These assets may only be used in connection with the specific company, organization, individual, product, solution, category, and award year for which recognition was granted.
Recognition assets may not be altered in a way that changes their meaning, creates misleading recognition, removes required branding, or suggests that an award applies to an unrecognized company, product, service, or year.
IoThinkTank may require correction or removal of recognition language, badges, graphics, logos, or promotional claims that are inaccurate, misleading, altered, expired, improperly attributed, or inconsistent with program guidelines.
12. Accounts and Security
If account functionality is available, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account.
You agree to notify IoThinkTank promptly if you become aware of unauthorized access, a suspected security issue, or misuse of an account or submission.
IoThinkTank may suspend or restrict account access when necessary to investigate security concerns, protect users, prevent misuse, or maintain website integrity.
13. Acceptable Use
You agree not to use the website or IoThinkTank services to:
- Submit false, misleading, unlawful, defamatory, infringing, or unauthorized materials.
- Impersonate another person, company, organization, product, or solution.
- Misrepresent business results, partnerships, customer relationships, certifications, deployments, or technical capabilities.
- Interfere with website security, availability, functionality, or performance.
- Attempt to access systems, accounts, data, or materials without authorization.
- Upload malicious code, spam, automated scraping tools, or harmful files.
- Manipulate, interfere with, or improperly influence the judging process.
- Violate applicable laws, third-party rights, contractual obligations, or program rules.
14. Third-Party Services and Links
The website may link to or integrate with third-party websites, payment processors, email platforms, analytics services, social platforms, embedded forms, document services, or other tools.
IoThinkTank does not control and is not responsible for third-party websites, services, policies, practices, content, security, or availability. Your use of third-party services may be subject to separate terms and privacy policies from those providers.
15. Disclaimers
The website, award programs, content, submission process, judging, recognition assets, and related services are provided on an “as is” and “as available” basis.
IoThinkTank does not guarantee uninterrupted access, error-free operation, a particular award outcome, business results, public visibility, media coverage, search rankings, sales, investment, partnerships, customer acquisition, or other commercial benefits.
To the fullest extent permitted by law, IoThinkTank disclaims warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or reliability.
16. Limitation of Liability
To the fullest extent permitted by law, IoThinkTank and its owners, employees, editors, contractors, judges, reviewers, affiliates, consultants, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the website, award submissions, payment processing, judging, recognition decisions, publication activities, or program participation.
This includes lost profits, lost revenue, lost data, reputational harm, lost opportunities, business interruption, reliance on award results, or unauthorized use of materials by third parties.
17. Indemnification
You agree to defend, indemnify, and hold harmless IoThinkTank and its owners, employees, editors, contractors, judges, reviewers, affiliates, consultants, and service providers from and against claims, damages, liabilities, losses, costs, or expenses arising from:
- Your submission materials.
- Your use of the website or award programs.
- Your violation of these Terms.
- Your violation of third-party rights.
- Your violation of applicable law.
- Claims that you lacked authority to submit an entry or supporting material.
18. Suspension, Disqualification, and Termination
IoThinkTank may suspend or terminate access to the website, submission process, accounts, services, or program participation if we believe you have violated these Terms, submitted inappropriate or misleading materials, misused recognition assets, failed to comply with program rules, violated an embargo, or engaged in conduct harmful to IoThinkTank or other participants.
IoThinkTank may revoke or correct an award if material information was false, misleading, unauthorized, or omitted, or if conduct discovered after selection would have affected eligibility or the award decision.
Provisions that by their nature should survive termination will continue to apply, including payment obligations, publicity permissions, intellectual property rights, disclaimers, limitation of liability, indemnification, governing law, and dispute-related provisions.
19. Privacy
Your use of the website and submission of information are also governed by the IoThinkTank Privacy Policy.
20. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to conflict-of-law principles.
Any dispute arising from or related to these Terms, the website, an award submission, payment, judging, recognition, or program activity will be resolved in a court with appropriate jurisdiction located in Davis County, Utah, unless applicable law requires otherwise.
21. Severability and Waiver
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect.
Failure by IoThinkTank to enforce a provision of these Terms does not waive the right to enforce that provision or another provision later.
22. Entire Agreement
These Terms, together with applicable award pages, category rules, application requirements, payment terms, and the IoThinkTank Privacy Policy, constitute the agreement between you and IoThinkTank regarding use of the website and participation in the awards programs.
If a written agreement signed by IoThinkTank directly conflicts with these Terms, the signed agreement will control to the extent of the conflict.
23. Changes to These Terms
IoThinkTank may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date.
If changes are material, we may provide additional notice where appropriate. Continued use of the website or participation in an IoThinkTank program after updates are posted means you accept the revised Terms.
